Terms and Conditions for Retail ABC Freight Services

Acceptance of Terms and Conditions By engaging the services of Retail ABC, hereinafter referred to as "RA," the customer acknowledges and agrees to the following terms and conditions. These terms and conditions shall apply to all services provided by RA, including but not limited to freight forwarding, transportation, and logistics services.

Limitation of Liability 2.1 RA shall not be held liable for any loss, damage, delay, or non-delivery of goods, regardless of the cause or origin, including but not limited to negligence, theft, acts of God, war, or any other circumstances beyond RA's reasonable control.
2.2 RA's liability for any loss or damage, whether in contract, tort, or otherwise, shall be limited to £0 unless a higher declared value has been agreed upon in writing by both parties.
2.3 RA shall not be liable for any consequential, indirect, or special damages arising from the loss, damage, delay, or non-delivery of goods, including but not limited to lost profits, loss of business opportunities, or any other economic loss.
- Insurance 3.1 RA may offer insurance services to customers upon request. Any insurance coverage provided by RA shall be subject to the terms and conditions of the insurance policy, and RA's liability shall be limited to the coverage provided by such policy.
3.2 Customers are responsible for declaring the value of their goods accurately and obtaining any necessary insurance coverage to protect against loss, damage, or delay during transportation or handling.
- Delays and Additional Charges 4.1 RA shall make reasonable efforts to adhere to agreed-upon delivery schedules. However, the customer acknowledges that there may be circumstances beyond RA's control that could cause delays.
4.2 In the event of delays caused by circumstances beyond RA's control, including but not limited to customs clearance delays, port congestion, or transportation disruptions, RA reserves the right to impose additional charges, including storage fees, demurrage charges, or other reasonable costs incurred as a result of such delays.

Force Majeure RA shall not be liable for any failure or delay in the performance of its obligations under these terms and conditions if such failure or delay is caused by circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, strikes, lockouts, labor disputes, or governmental actions.

Indemnification The customer agrees to indemnify, defend, and hold RA harmless from any claims, demands, losses, liabilities, costs, and expenses (including reasonable attorney fees) arising out of or in connection with the customer's breach of these terms and conditions or any negligent or willful act or omission by the customer.

Governing Law and Jurisdiction These terms and conditions shall be governed by and construed in accordance with the laws of the United Kingdom. Any dispute arising out of or in connection with these terms and conditions shall be subject to the exclusive jurisdiction of the courts of the United Kingdom.

Severability If any provision of these terms and conditions is held to be invalid, illegal, or unenforceable, the validity, legality, and enforceability of the remaining provisions shall not in any way be affected or impaired.
By engaging the services of Retail ABC, the customer acknowledges that they have read, understood, and agreed to these terms and conditions in their entirety, including the potential for additional charges due to delays beyond RA's control
